PocFin - Terms and Conditions

Welcome to PocFin! By accessing or using our mobile application ("PocFin" or "the App"), you agree to be bound by these Terms and Conditions and our Privacy Policy. Please read them carefully before using our services. If you do not agree with any part of these terms, you must not use PocFin.

1. General Information

• PocFin's Purpose: PocFin is a budgeting and financial tracking application designed to help users manage personal finances, track spending, set savings goals, and monitor financial habits. It is provided for informational and organizational purposes only and is not intended to provide, and does not constitute, financial, investment, legal, or tax advice. Any financial decisions you make are your sole responsibility.
• No Financial Advice: PocFin does not act as a financial advisor, broker, or agent. We do not endorse or recommend any financial products or services.
• Acceptance of Terms: By accessing or using the App, you acknowledge that you have read, understood, and agree to these Terms and Conditions and our Privacy Policy.

2. Use of the App

• Personal Use Only: PocFin is intended solely for your personal, non-commercial use. You may not use the App for business, commercial, or institutional financial tracking without explicit written consent from PocFin.
• Prohibited Uses: You agree not to use the App for any unlawful purpose or in any way that could harm PocFin, its users, or any third party. Prohibited activities include, but are not limited to: attempting to gain unauthorized access to the App or its systems, interfering with the App's functionality or security, using the App to transmit any viruses, malware, or other harmful code, or engaging in any activity that could disable, overburden, or impair the App's servers or networks.

3. Account and Data Security

• Account Security: You are solely responsible for maintaining the confidentiality of your account login credentials (e.g., password, PIN) and for all activities that occur under your account. You agree to notify PocFin immediately of any unauthorized use of your account or any other breach of security. PocFin is not liable for any loss or damage arising from your failure to protect your account information.
• Device Security: You are responsible for ensuring the security of your own devices used to access PocFin, including implementing strong passwords, using up-to-date antivirus software, and keeping your operating system current.
• Data Handling & Types of Data Stored: Your financial data, which may include transaction history, budget settings, financial goals, and other related financial information entered by you, is stored securely. PocFin explicitly states that it does not store or have access to any personal payment information (e.g., credit card numbers, debit card numbers, bank account numbers, or full bank details). All financial data within PocFin is entered manually by the user or, if offered, imported via secure, encrypted third-party integrations where PocFin acts only as a conduit and does not store sensitive credentials.
• Data Encryption: All data transmitted between your device and PocFin's servers is encrypted using industry-standard protocols. Data at rest on our servers is also encrypted.

4. Financial Data Accuracy

• User Responsibility for Accuracy: You are entirely responsible for the accuracy, completeness, and timeliness of all financial data you input into PocFin, including but not limited to budget amounts, transaction details, categories, and any other financial information.
• No Guarantee of Accuracy: PocFin provides tools to assist in tracking and organizing your finances but does not verify, guarantee, or assume responsibility for the accuracy of the data you input. We are not liable for any errors, omissions, or misinterpretations of financial information resulting from incorrect user input or reliance on the App's presented data without independent verification.
• Discrepancies: In the event of any discrepancy between the financial information displayed in PocFin and your actual bank statements or financial records, your official financial records shall always take precedence.

5. AI Integration and Data Use

• User-Controlled AI Interaction: PocFin may offer optional Artificial Intelligence ("AI") features designed to provide insights, analysis, or recommendations based on your financial data. You acknowledge and agree that the use of these AI features and the sharing of your financial data with the AI is entirely at your discretion and subject to your explicit consent within the App.
• Purpose of AI Use: When you opt-in to use AI features, your data may be processed by AI algorithms for purposes such as: categorizing transactions, identifying spending patterns, suggesting budget adjustments, providing personalized financial insights (e.g., areas for potential savings), and generating summaries or reports of your financial activity.
• Data Anonymization/Pseudonymization for AI Training: Where possible and practical, and where required by law, data used for AI model training and improvement will be anonymized or pseudonymized to protect your identity. You grant PocFin a non-exclusive, worldwide, royalty-free license to use your anonymized and/or aggregated data for the purpose of improving PocFin's services, including its AI models. This data will not be used to identify you personally.
• AI Limitations and Risks: AI is a rapidly evolving field and its outputs are probabilistic. This means AI-generated insights, categorizations, or recommendations may not always be perfectly accurate, complete, or free from errors, biases, or "hallucinations." AI-generated content is for informational purposes only and does not constitute financial, investment, legal, or other professional advice. You should always exercise your own judgment and, where necessary, consult with a qualified professional before making any financial decisions based on AI insights.
• User Review: You are responsible for reviewing and verifying the accuracy and appropriateness of any AI-generated output before acting upon it.
• Data Minimization: We strive to collect and process only the data necessary for the functionality of PocFin and its AI features, in line with the principles of data minimization.

6. Limitations of Liability

• No Liability for Financial Losses: PocFin is provided "as is" and "as available." To the fullest extent permitted by law, PocFin, its affiliates, officers, directors, employees, agents, and licensors will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, financial losses, loss of data, loss of profits, or business interruption, arising from your use or inability to use the App, even if advised of the possibility of such damages.
• Not a Substitute for Professional Advice: PocFin is a budgeting tool designed to assist users in managing finances and does not replace professional financial advice. Your financial outcomes depend on your individual input, financial decisions, and market conditions.
• Third-Party Services: PocFin may integrate with or link to third-party services. We are not responsible for the terms, conditions, privacy practices, or content of any third-party services. Your use of such third-party services is at your own risk.

7. Data Privacy (POPIA Compliance)

• Your Privacy is Paramount: Your privacy is critically important to us. Our detailed Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, process, store, protect, and share your information, including personal information, in compliance with the Protection of Personal Information Act (POPIA) of South Africa.
• Consent: By using PocFin, you explicitly consent to our data handling practices as described in our Privacy Policy and these Terms and Conditions.
• Non-Personal Information: The App may collect non-personal information such as device type, anonymized usage data, and aggregated statistics for analytics, troubleshooting, and improvement purposes. This information does not identify you personally.
• Data Subject Rights: In accordance with POPIA, you have certain rights regarding your personal information, including the right to access, correct, object to the processing of, and request deletion of your personal information. 8. Modifications and Updates

• Changes to Terms: PocFin reserves the right to modify or update these Terms and Conditions at any time. We will notify you of any material changes by posting the updated terms within the App or on our website, and by updating the "Last updated" date.
• Continued Use: Your continued use of the App after any such modifications constitutes your acceptance of the updated Terms and Conditions. If you do not agree to the modified terms, you must stop using PocFin and delete your account.
• App Updates: PocFin may periodically release updates to the App, including new features, bug fixes, or security enhancements. You agree to install these updates to ensure optimal functionality and security.

9. Termination of Services

• PocFin's Right to Terminate: We reserve the right, at our sole discretion, to suspend or terminate your access to PocFin, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions or misuse the App's functionality.
• User Termination: You may delete your PocFin account at any time by contacting customer support through the App or by following the account deletion process provided within the App settings. Upon account deletion, we will take reasonable steps to delete your personal and financial data in accordance with our Privacy Policy and applicable law.

10. Governing Law and Dispute Resolution

• Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles.
• Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms and Conditions, or the breach, termination, or invalidity thereof, shall first be attempted to be resolved amicably through good faith negotiations. If a resolution cannot be reached, the dispute shall be submitted to the exclusive jurisdiction of the competent courts located in South Africa.
